As with other types of litigation, business litigation is expensive, time-consuming, difficult, and at times exhausting, for the litigants. Litigation should be pursued only as a last resort, after all other attempts at resolving differences with the opposing party have been exhausted, or at least examined.
Filing fees alone for a jury trial are more than $400.00, and a plaintiff may expect to pay several thousand dollars for a lawyer to draft and file a Complaint in Colorado District Court. That said, there may be strong justification for proceeding to litigation, such as fraud, civil theft, breach of fiduciary duty, blatant contract violations, and violations of public policy, committed by the opposing party that warrant litigation. Sometimes, either by contract or by Colorado Statute, the prevailing party may recover a portion of attorney fees paid, in addition to all costs.
